Deutsche Telekom Loses Bid to Overturn Antitrust Fine (Update5)
April 10 (Bloomberg) — Deutsche Telekom AG, Europe’s biggest phone company, lost an appeals-court bid to overturn a 12.6 million-euro ($19.9 million) European Union antitrust fine for abusing its dominant market position in Germany.
The European Commission, the EU’s antitrust regulator, accused Deutsche Telekom in May 2003 of overcharging competitors for access to its local phone network, saying the Bonn-based company’s so-called margin squeeze deterred new companies from entering the market. Deutsche Telekom, which appealed two months later, agreed to cut its fees in 2004.

Telecoms: Commission supports move to lower termination rates in Italy, highlights inconsistency across EU

The European Commission has welcomed efforts by the Italian telecoms regulator (AGCOM) to lower termination rates of alternative fixed network operators. In a letter sent to AGCOM today, the Commission agrees with the regulator’s proposal for a cost-oriented approach leading to a symmetric termination rate of 0.57 euro cent/min for all fixed network operators by 1 July 2010. At the same time, however, the Commission remains concerned about inconsistent levels of termination rates across the EU.

CWA and ver.di, Germany’s largest union, officially established the first-ever union to unite and represent workers in the U.S. and Europe — T Union, a joint affiliate of both organizations. Top officers of both unions formally signed the new partnership during a video conference and talked through strategies and plans for the new organization.
The new union will support T-Mobile workers who want a union voice and collective bargaining rights in the United States and other countries, and German union members who work for T-Mobile in the U.S. A new website is now live, where T-Mobile workers can safely share information and experiences and discuss workplace issues. That site is www.t-mobileunion.org. A text messaging system for U.S. members only also is up and running: text TUNION to 77007 to get a message about the campaign.

A mobilni operatori… eh…

Homezone + DSL = FMC Killer?
Bundling an all-mobile FMS homezone solution with DSL is a far simpler way to achieve a home-based ‘total communications solution’ than a UMA-enabled FMC alternative such as BT’s Fusion or Orange’s Unik, and we believe this formula will start to become a more widespread feature of the bundled service landscape in the coming months. Vodafone Germany was one of the first mobile operators to introduce a bundle of an all-mobile zonal tariff and DSL to strengthen its FMS proposition, but the same model has also emerged in Italy, France and Belgium. We anticipate that this formula will start appearing in other European markets currently hosting all-mobile ‘homezone’ mobile tariffs, notably the Netherlands and the UK. For the purposes of this report, we will look at some early examples of this practice and point out features and value-added opportunities this service formula grants mobile operators keen to establish a profile as a new broadband player.

It’s Not Paranoia: Internet Users Really Are Being Spied On
The Federal Trade Commission has proposed self-regulatory guidelines for companies that do behavioral targeting. That’s good, but self-regulation is not enough. One idea starting to gain traction in Congress is a do-not-track list, similar to the federal do-not-call list, which would allow Internet users to opt out of being spied on.

Defendants: MediaSentry needs a license and the evidence it collected is worthless
A college student at Northern Michigan University representing him or herself recently submitted a motion seeking to quash a subpoena directed at the school, arguing that the data collected by MediaSentry was "obtained through felonious conduct." The motion refers to a ruling made last month by the Michigan Department of Labor and Economic Growth that MediaSentry needs to be licensed in order to "perform regulated activities." Regulators at the department have reportedly sent the company a letter informing them of the decision, although MediaSentry refused to confirm receipt to Ars. The company has also received a cease-and-desist order from the Massachusetts State Police saying that its investigative activities violate state law.

EU groups: data retention policies violate Rights Convention
A group of 43 European civil liberties groups today filed a brief with the European Court of Justice in Luxembourg that argues for overturning a 2006 EU directive mandating data retention policies across EU countries. The groups assert that the directive is illegal, but more importantly that the directive interferes with basic human rights granted to all Europeans. Not only that, but they don’t think data retention will make people safer, and on a continent with a history of surveillance states, potential abuses of power are always an issue.

Security experts have hacked ATMs to show how easy it is to steal money and bank account details from modern cash machines.
ATMs, or automated teller machines, today face the Internet-born threat of worms and denial-of-service attacks, as well as being at risk from malicious applications that can harvest customer data or hijack machines.
Up to 90 percent of the ATMs in the U.K. could be at risk from these attacks as they rely on desktop PC technology–usually Intel hardware and Windows operating systems–linked to other machines, some connected to the Internet, in the bank’s network, according to experts.
